Terms of Service

1. Acceptance of Terms

By accessing or using BookedHer ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Eligibility

You must be at least 18 years old to use BookedHer. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Description of Service

BookedHer is an online marketplace that connects beauty professionals ("Beauty Pros") with clients seeking beauty services ("Clients"). BookedHer is a platform only. We do not provide beauty services, employ Beauty Pros, or guarantee the quality, safety, or legality of services offered through the Platform.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information during registration.
• You may not create multiple accounts, impersonate another person, or use a false identity.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Beauty Pro Obligations

If you register as a Beauty Pro, you additionally represent and warrant that:

• You hold all licenses, permits, and certifications required by your state, county, or municipality to perform the beauty services you offer.
• You will maintain such licenses in good standing for the duration of your use of the Platform.
• You are solely responsible for the quality, safety, and legality of the services you provide.
• You will comply with all applicable health and safety regulations.
• You will accurately represent your qualifications, services, and pricing on your profile.
• You are an independent contractor and not an employee, agent, or representative of BookedHer.

6. Beauty Pro Subscriptions

• Beauty Pros may subscribe to a paid plan at $8.00 per month, billed monthly.
• Subscriptions automatically renew each month until cancelled.
• You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period — you will not be charged again after cancellation.
• Subscription fees are non-refundable. Upon cancellation, you retain access to paid features until the end of your current billing period.
• We reserve the right to change subscription pricing with 30 days' notice. You may cancel before the price change takes effect.
• If you cancel during a free trial (if offered), you will not be charged.

7. Bookings and Payments Between Users

• Bookings made through the Platform are agreements between the Client and the Beauty Pro. BookedHer is not a party to these agreements.
• Payment for beauty services is arranged directly between the Client and Beauty Pro. BookedHer does not process payments for services rendered.
• Cancellation policies for individual bookings are determined by the Beauty Pro. BookedHer is not responsible for refunds related to service bookings.

8. User Content

• You retain ownership of content you upload to the Platform (photos, reviews, profile information).
• By uploading content, you grant BookedHer a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content on and in connection with the Platform.
• This license terminates when you delete your content or account, except where your content has been shared with or used by other users in accordance with these Terms.
• You represent that you own or have the right to use any content you upload and that it does not infringe on any third party's rights.
• We reserve the right to remove content that violates these Terms or is otherwise objectionable.

9. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Harass, abuse, or threaten other users
• Upload false, misleading, or fraudulent content
• Impersonate any person or entity
• Upload content that infringes intellectual property rights
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Use the Platform to distribute spam, malware, or other harmful content
• Scrape, crawl, or use automated means to access the Platform without our consent
• Interfere with the proper functioning of the Platform
• Circumvent, disable, or interfere with any security features of the Platform

10. DMCA / Copyright Policy

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA).

Filing a takedown notice: If you believe content on BookedHer infringes your copyright, send a DMCA takedown notice to dmca@bookedher.com with:

• A description of the copyrighted work you claim has been infringed
• The URL of the infringing content on our Platform
• Your contact information (name, address, phone, email)
• A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

Counter-notification: If you believe your content was removed by mistake or misidentification, you may file a counter-notification with:

• Identification of the removed content and its location before removal
• A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
• Your name, address, and phone number
• A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service from the person who filed the original notice
• Your physical or electronic signature

Repeat infringers: We will terminate the accounts of users who are repeat copyright infringers.

11. Termination

• By you: You may terminate your account at any time by deleting it through your account settings or by contacting us at support@bookedher.com.
• By us: We may suspend or terminate your account at any time, with or without notice, for violation of these Terms, fraudulent activity, or any other reason at our sole discretion.
• Effect of termination: Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination will survive, including but not limited to: Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution.
• If you have an active subscription, termination does not entitle you to a refund of any fees already paid.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BookedHer does not warrant that:

• The Platform will be uninterrupted, secure, or error-free
• Beauty Pros are licensed, insured, or qualified
• Services booked through the Platform will meet your expectations
• Any information on the Platform is accurate or complete

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKEDHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO BOOKEDHER IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless BookedHer, its owners, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third party's rights
• Any dispute between you and another user
• Any beauty services provided or received through the Platform

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in the State of Maryland, in accordance with the rules of the American Arbitration Association.

You agree to waive your right to a jury trial and to participate in a class action lawsuit. This arbitration agreement does not prevent you from filing a complaint with any government agency.

Small claims exception: Either party may bring an individual action in small claims court as an alternative to arbitration.

Opt-out: You may opt out of this arbitration agreement by sending written notice to legal@bookedher.com within 30 days of first accepting these Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.

17. Changes to Terms

We may update these Terms from time to time. For material changes, we will notify you by email (if we have your email) and by posting the updated Terms on this page with a new "Last updated" date. Material changes take effect 30 days after posting. Your continued use of the Platform after that period constitutes acceptance of the updated Terms.

18. General Provisions

• Entire agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and BookedHer regarding the Platform.
• Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
• Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
• Force majeure: BookedHer shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, government actions, or internet or power failures.
• Notices: We may provide notices to you via email, through the Platform, or by posting on our website. You may provide notices to us at the email addresses listed in these Terms.
