Terms of Service

1. Acceptance of Terms

By accessing or using BookedHer ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Eligibility

You must be at least 18 years old to use BookedHer. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Description of Service

BookedHer is an online marketplace that connects beauty professionals ("Beauty Pros") with clients seeking beauty services ("Clients"). BookedHer is a platform only. We do not provide beauty services, employ Beauty Pros, or guarantee the quality, safety, or legality of services offered through the Platform.

4. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information during registration.
  • You may not create multiple accounts, impersonate another person, or use a false identity.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Beauty Pro Subscriptions

  • Beauty Pros may subscribe to a paid plan at $5.00 per month, billed monthly.
  • Subscriptions automatically renew each month until cancelled.
  • You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period.
  • Subscription fees are non-refundable. Upon cancellation, you retain access to paid features until the end of your current billing period.
  • We reserve the right to change subscription pricing with 30 days' notice.

6. Bookings and Payments Between Users

  • Bookings made through the Platform are agreements between the Client and the Beauty Pro. BookedHer is not a party to these agreements.
  • Payment for beauty services is arranged directly between the Client and Beauty Pro. BookedHer does not process payments for services rendered.
  • Cancellation policies for individual bookings are determined by the Beauty Pro. BookedHer is not responsible for refunds related to service bookings.

7. User Content

  • You retain ownership of content you upload to the Platform (photos, reviews, profile information).
  • By uploading content, you grant BookedHer a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content on and in connection with the Platform.
  • You represent that you own or have the right to use any content you upload and that it does not infringe on any third party's rights.
  • We reserve the right to remove content that violates these Terms or is otherwise objectionable.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Harass, abuse, or threaten other users
  • Upload false, misleading, or fraudulent content
  • Impersonate any person or entity
  • Upload content that infringes intellectual property rights
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Use the Platform to distribute spam, malware, or other harmful content
  • Scrape, crawl, or use automated means to access the Platform without our consent
  • Interfere with the proper functioning of the Platform

9. DMCA / Copyright Policy

We respect intellectual property rights. If you believe content on BookedHer infringes your copyright, please send a DMCA takedown notice to dmca@bookedher.com with:

  • A description of the copyrighted work you claim has been infringed
  • The URL of the infringing content on our Platform
  • Your contact information
  • A statement that you have a good faith belief the use is not authorized
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

We will respond to valid DMCA notices promptly. Users who repeatedly infringe copyrights may have their accounts terminated.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BookedHer does not warrant that:

  • The Platform will be uninterrupted, secure, or error-free
  • Beauty Pros are licensed, insured, or qualified
  • Services booked through the Platform will meet your expectations
  • Any information on the Platform is accurate or complete

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKEDHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO BOOKEDHER IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless BookedHer, its owners, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Any dispute between you and another user
  • Any beauty services provided or received through the Platform

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in the State of Maryland, in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in a class action lawsuit.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
